By accessing or using the Housedar platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Housedar reserves the right to update these terms at any time with notice posted on the platform. Continued use after changes constitutes acceptance.

Housedar provides AI-powered property price simulation and market prediction reports. The Service uses proprietary algorithms, structured market data, and simulated buyer behaviour models to generate predictions about property pricing and market demand. The Service is intended for informational and planning purposes only.

IMPORTANT DISCLOSURE — AUTOMATED DECISION SYSTEM: Housedar's predictions are generated entirely by automated AI simulation. No human reviews individual simulation outputs before delivery. The system uses large language models, agent-based simulation, and statistical ensemble methods. Outputs reflect probabilistic scenarios, not guaranteed outcomes.

ALL PREDICTIONS, REPORTS, SELL SCORES, PRICE RANGES, CONFIDENCE INTERVALS, PROBABILITY ESTIMATES, AND MARKET ANALYSES GENERATED BY HOUSEDAR ARE SIMULATIONS AND ESTIMATES ONLY. THEY ARE NOT FINANCIAL ADVICE, REAL ESTATE ADVICE, INVESTMENT ADVICE, OR LEGAL ADVICE OF ANY KIND.

HOUSEDAR DOES NOT GUARANTEE THAT ANY PROPERTY WILL SELL AT THE PREDICTED PRICE OR WITHIN THE PREDICTED TIMEFRAME. ACTUAL MARKET OUTCOMES MAY DIFFER MATERIALLY FROM SIMULATION RESULTS. PAST SIMULATION ACCURACY DOES NOT GUARANTEE FUTURE ACCURACY.

YOU MUST CONSULT A LICENSED REAL ESTATE PROFESSIONAL, FINANCIAL ADVISER, AND/OR LEGAL COUNSEL BEFORE MAKING ANY PROPERTY-RELATED DECISIONS. HOUSEDAR ACCEPTS NO LIABILITY WHATSOEVER FOR DECISIONS MADE BASED ON SIMULATION OUTPUT, INCLUDING BUT NOT LIMITED TO PURCHASE DECISIONS, SALE DECISIONS, INVESTMENT DECISIONS, OR FINANCING DECISIONS.

This disclaimer is reproduced on every simulation report generated by Housedar and forms an integral part of every output delivered through the Service.

You must be at least 18 years of age to use the Service. By using Housedar, you represent that you meet this requirement and have the legal capacity to enter into a binding contract. The Service is available globally, subject to applicable local laws and regulations. Users in jurisdictions where AI-generated forecasting tools are restricted or prohibited are not permitted to use the Service.

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted under your account. You agree to provide accurate and complete registration information and to update it as necessary. Notify us immediately at [email protected] if you suspect unauthorised access to your account.

Access to full simulation reports requires the purchase of simulation credits or a paid subscription plan. All payments are processed by Stripe, Inc. Prices are displayed in USD unless otherwise stated. Credits are non-refundable once a simulation has been initiated and the pipeline has begun processing. Unused credits may be refunded within 14 days of purchase if no simulation has been run. Housedar reserves the right to change pricing at any time with at least 14 days notice to existing subscribers. Annual subscriptions will auto-renew unless cancelled at least 7 days before the renewal date.

All content, algorithms, data models, prediction pipelines, reports, branding, and platform code are the intellectual property of Housedar Inc. and are protected by applicable intellectual property laws. You may not reproduce, distribute, reverse-engineer, decompile, or create derivative works from any part of the Service without express written permission from Housedar Inc.

Simulation reports generated for your specific property are licensed to you for personal, non-commercial use only. You may share a report using the platform's built-in share functionality. You may not resell, sub-license, or commercially distribute simulation reports without a separate written commercial licence from Housedar Inc.

You may not use the Service to: (a) scrape, harvest, or systematically extract data from the platform; (b) attempt to reverse-engineer, probe, or circumvent the prediction model or any security measures; (c) resell or redistribute simulation reports commercially without written authorisation; (d) submit false, misleading, or fabricated property data to manipulate or game simulation results; (e) use the Service in any way that violates applicable local, state, national, or international law; (f) impersonate another person or entity; (g) transmit malicious code, viruses, or disruptive technologies; or (h) use automated bots or scripts to access the platform without prior written consent.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOUSEDAR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. THIS INCLUDES BUT IS NOT LIMITED TO: LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, REAL ESTATE TRANSACTION LOSSES, INVESTMENT LOSSES, FINANCING LOSSES, OR ANY FINANCIAL LOSS OF ANY KIND RESULTING DIRECTLY OR INDIRECTLY FROM RELIANCE ON SIMULATION OUTPUT.

IN NO EVENT SHALL HOUSEDAR'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE TOTAL AMOUNT PAID BY YOU TO HOUSEDAR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IF YOU HAVE PAID NOTHING, HOUSEDAR'S LIABILITY SHALL BE LIMITED TO ONE HUNDRED US DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, liability is limited to the fullest extent permitted by law.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. HOUSEDAR EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. HOUSEDAR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

You agree to indemnify, defend, and hold harmless Housedar Inc. and its officers, directors, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your infringement of any third-party rights; or (d) any decisions you make based on simulation output.

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively through binding individual arbitration, not in court. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. You also waive your right to participate in a representative action under any applicable statute.

Arbitration shall be conducted by a mutually agreed arbitration provider under its then-current rules. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Nothing in this section prevents either party from seeking emergency injunctive relief from a court to prevent irreparable harm pending arbitration.

If the class action waiver is found unenforceable for any reason, then the entirety of this arbitration agreement shall be null and void, and the dispute shall be resolved in the courts specified below.

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of law principles. Any disputes not subject to arbitration under Section 12 shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction in those courts.

Housedar uses cookies and similar tracking technologies to operate and improve the Service.

Strictly Necessary Cookies: Required for the platform to function. These include session authentication cookies and security tokens. These cannot be disabled.

Analytics Cookies: Used to understand how users interact with the platform (e.g., pages visited, time on page). These are disabled by default and activated only with your explicit consent via the cookie consent banner.

Preference Cookies: Remember your settings and preferences across sessions. Activated only with consent.

We do not use third-party advertising trackers or sell cookie data to any party. You may manage your cookie preferences at any time via the cookie settings panel accessible from the footer of every page. Withdrawing consent will not affect the lawfulness of processing based on consent before its withdrawal.

Housedar shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, government action, internet outages, third-party API failures, or power failures.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.

These Terms, together with the Privacy Policy and any additional terms presented at the time of purchase, constitute the entire agreement between you and Housedar Inc. regarding the Service and supersede all prior agreements and understandings.
